NAIC Model Laws

The NAIC is the standard-setting and coordinating body of the United States' fifty state insurance regulators. It writes model laws and regulations that states may adopt, accredits state departments, and operates shared infrastructure including SERFF, the system through which carriers file rates and forms in every state. It has no direct regulatory authority of its own.

The NAIC is what coordination looks like without compulsion, and its technology estate is a fair reflection of that position.

  • Model laws, adopted at state discretion - The NAIC drafts; each state legislature or department decides. Uniformity is an aspiration, not a guarantee.
  • Accreditation as leverage - The main lever is accrediting state departments against standards, which shapes behaviour indirectly.
  • SERFF - Rate and form filing, the highest-volume machine-to-machine transaction in American insurance, performed by every carrier in every state.
  • Statutory reporting - Annual Statement Blanks, the Market Conduct Annual Statement and the Financial Data Repository are the real data flows, and they are regulatory reporting formats rather than APIs.

Two findings from The State of US Insurance APIs belong on this entry. SERFF — the filing rail every carrier in the country depends on — is provisioned by emailing a request address and has no public machine-readable contract. And a full-text scan of the NAIC’s official technology products and services catalog, 1.5 megabytes and 57,226 characters, contains no occurrence of the word developer. A regulator’s technology catalog that never says developer is telling you exactly who it believes its audience is.
